Planning Application – Ousterne Lane ref: PAP/2012/0394


The following is intended to give anyone who has an objection to the above planning application the opportunity to inform NWBC of their reasons for objection.  It has been written by residents of Fillongley as a guidance tool to help in the formulation of your own objection. You are advised to check any items yourself however feel free to use any or all of the information shown here.   You must submit your own objection, with or without any of our points, but are urged to read the section PLANNING APPLICATION before you do.  Please remember any objection is a public document and will be available to all, including the planning applicant.


You have until 28th August 2012 to formally lodge an objection.

How to object is shown at the end of this post.

Planning Application

The following is an excerpt from the letter from NWBC to the neighbouring properties regarding what can and cannot be considered for comments on the application:-

What will be considered?

The Council considers a number of different matters.  The most important will be how the proposal fairs against planning policy, and you are advised to familiarise yourself with this at www.northwarks.gov.uk/planning prior to making any comments.

What will not be considered?

The Government makes it very clear that some matters are not “planning consideration”.  These include matters addressed by other legislation; property rights such as boundary and access disputes, covenants or private drainage concerns; morals or motives; speculation; loss of a view; property value; and any form of prejudice.

Our summary regarding considerations.

Any objection MUST be showing that the proposed plan DOES NOT meet with the NWBC Planning Policy.  No other reasons will be considered, such as “I think it is ugly”, “I don’t want it” or “There are better ways for the Club to raise money” as they can only act within their own agreed guidelines.

What you CAN object to

We have reviewed the NWBC’s Local Plan (July 2006) which can be found on the internet at:  NWBC Local Plan 2006 and you can say “It doesn’t comply with” or “It doesn’t agree with ”any of the statements therein.  The proposed development does not comply with the following policies, and the reasons why are also shown.  Please read through it yourself and find anything that has been missed.


1.       Section 2.2 “ Play our strategic part by restraining new developments” and “seek to protect....historic heritage”

Objection to proposal:
The proposed building obscures the view of two listed buildings and changes the nature of the conservation area.

2.       Core Policy 2 (2) “housing development will be limited to that which a local affordable housing need has been identified”.

Objection to proposal:
The proposed building is not “affordable housing” it is a speculative development for which there is little or no demand. There were 19 two or three bedroom properties for sale in Fillongley as at 16 August 2012 (Rightmove.com).

3.       Core Policy 3. “All developments will seek to protect or enhance....the historic environment”

Objection to proposal:
The proposed development obscures the view of two listed buildings in Fillongley.

4.       Core Policy 11. “All development will be required to be well designed and to respect and/or enhance its surroundings”.

Objection to proposal:
The proposed building does not respect its surroundings, it is a timber faced structure within an area that are predominantly red brick with some stucco features.

5.       Chapter 3, 3.22 paragraph 6. “The Plan will help to do this and in particular will promote....The Boroughs rich heritage of historic buildings”.

Objection to proposal:
The proposed development will obscure two grade 2 and grade 2* listed buildings from the view of the public and be a detriment to the Borough.

6.       Chapter 3, ENV 11. “Development will not be permitted if the occupiers of nearby properties would suffer significant loss of privacy or disturbance due to...light” and “occupiers of the development should also enjoy satisfactory standards of these amenities.”

Objection to proposal:
The proposed development would deprive Alpha House of light during the afternoon and evening as it stands 6.2 meters tall to the west side of the building.
The proposed building would be denied any light at all in its garden as it is surrounded by walls at least 2 meters high on all sides and is north facing.
The proposed building would not have any natural light from noon onwards as there are no windows to the west of the building.

7.       Chapter 3, ENV12 (iv). “The design and layout reduces opportunities for crime”.

Objection to proposal:
The proposed development means that the Club Steward’s vehicle and those of his/her family will no longer be in view of the occupants and will therefore be vulnerable to theft.

8.       Chapter 3. ENV 13. 1. “New buildings....will only be permitted where (i) The scale, massing, height and appearance of the proposed positively integrates into its surroundings and (ii) The materials and detailing used respects and enhances local distinctiveness”.

Objection to proposal:
The proposed building does not respect the local environment, it is a timber clad, two storey, enlarged shed whereas the buildings around are red brick or stucco.

9.       Chapter 3. ENV 15. 2. “Development inside or outside a Conservation Area will not be permitted if it would have a harmful effect on  the character, appearance or setting of a Conservation Area or views into or out of the area”.

Objection to proposal:
The proposed building will completely obscure the view to and from a grade 2 and a grade 2* listed building in the Conservation Area.

10.   Chapter 3. ENV 15. 5. “New buildings within and adjoining a Conservation Area will be required to harmonise with their settings, reflecting the scale, form and fenestration of traditional buildings in the area and using materials characteristic of the area.”

Objection to proposal:
The proposed building is a wooden clad, two storey, enlarged wooden shed whilst the surrounding building are either red brick or stucco.

11.   Chapter 3. ENV 16. 2. “Development that would detract from the character, appearance of historic value of a listed building ....in terms of historic form and layouts or its setting will not be permitted”.

Objection to proposal:
The proposed development will obscure the view of two grade 2 and grade 2* buildings.

12.   Chapter 4 HSG 2.5 “New housing in other settlements will only be permitted where a need has been  identified following a systematic analysis involving the local community concerned, land owners and housing providers and will be limited to affordable housing that will remain such in perpetuity”

Objection to proposal:
The proposed development does not meet this criteria, there is no need for affordable housing even single working men are housed by the Council and there are 16 two and three bedroom properties for sale (Rightmove,com 16/8/12). There has been no systematic analysis and the building is not affordable housing.

The following details where the proposed building contravenes the Draft Core Strategy which can be viewed at  Local Core Strategy (you need to download each chapter separately).

With regard to the Draft Core Strategy this application does not comply with the following:-

Chapter 2 – Local Plan Strategy


2.80.1 “Quality of its....historic environment”

Objection to proposal:
The proposed building obscures the view of a grade 2 and a grade 2* listed building.

2.80.4 “Local style”

Objection to proposal:
The proposed, timber clad, building does not accord with the red brick and stucco buildings in the area.

Chapter 3 -  Natural and Built Environment


3.2 “The rural character....will be retained and re-inforced”. “Protection, restoration and en-hancement...of historic resources”. “historic areas and buildings....are protected and enhanced”.

Objection to proposal:
The proposed building destroys the character of the village and reduces the historic views.
